Datopia Terms and Conditions of Use

Definitions of terms

In these General Terms of Use (GTU), the following terms are defined as follows:

• Datopia SAS Datopia SAS, a simplified joint stock company with capital of 11,066.63 euros, registered in the Tours Trade and Companies Register under number 979 286 812, owner and operator of the Application.
• Application Datopia application, as available on the Apple App Store and Google Play Store.
• Datopia The application
• CGU The present General Terms and Conditions of Use, applicable to Members registered on the Application.
• Member Any person registered on the Application, including Members subscribing to Premium offers.
• Account Member's personal space, including profile, messaging and settings, containing personal information and preferences.
• Services All the free or paid features offered by Datopia to encourage interaction and meetings between members.
• Premium subscription : Paid subscription offering Members access to additional features and benefits.
• Pack : Non-subscription purchase, in batches of several, of features usually included in premium subscriptions.
• Selfie: Digital self-portrait that we ask our Members to take with their smartphone when they register with Datopia.
• Avatar The digital representation of a Datopia Member
• Doppia Avatar created by the Member to interact in the virtual world of Datopia.
• Reveal Reveal photo: Photo of a Member associated with his/her avatar and visible to other Members when the avatar is presented in the Station. This photo is only revealed on request, and each Member is only entitled to a limited number of Reveal photo consultations per day. Subscribing Members have an increased or unlimited number of Reveals per day.
• Rewind : Functionality that allows you to return to an avatar you have just ignored in the Station. This feature is not available when the Application is launched.
• Like : Mark of interest. The like is used to show interest in a Doppia. If this interest is mutual, the two Doppia can meet and play together.
• Invitation: An invitation to discover and play.
• Connection A mutual acceptance by two Members to initiate a privileged relationship between them, triggered either by a Like made by each of the two users to the other (mutual Like), or after acceptance of an Invitation to Play sent to the other by one of the two Members.
• La Station Members' home page, where they can see the avatars of other members of the application.
• Bubble The private space where Datopia members can play and communicate with each other.
• Mini-games Playful interactions enabling Members to discover each other in a fun way through interactive games integrated into the Application.
• Boost This feature increases the visibility of a Member's profile for a limited period of time. This feature will not be available when the Application is launched.
• Globe-trotting mode : Functionality enabling a Member to geolocate to a location other than the one in which he or she is currently located.
• Incognito mode : Functionality enabling a Member to appear only in the Stations of Members with whom he or she has interacted through Likes and/or Invitations.

Application description

Datopia is a dating application that lets members get to know each other by meeting online in a fun way. "Virtual connection, real emotions".

Each Member is represented by an avatar, the Doppia. "Behind every avatar, there's a little heart beating...".

In the meeting space where our Members discover each other, the Station, their avatars are visible, accompanied by a mini-profile: a real profile photo, the Reveal, a short biography if provided by the Member, a first name, an age.

The avatars visible in our Members' Stations correspond to the preferences indicated when they registered.

Each avatar can invite another avatar to play the mini-games we offer. If both avatars agree, they'll meet in a private space, the Bubble, where they'll play and discover each other with their own voice, their real appearance if they accept the optional use of video and instant messaging.

After playing, talking and, where appropriate, seeing each other, Members can decide whether or not to take their virtual or real relationship further, as they see fit. They have access to the other Member's complete profile (photo gallery, etc.), and a private space dedicated to them, the Bubble, where they can play and communicate at their leisure.

No more matches and crushes with no follow-up, and no more appointments with unpleasant surprises in real life!

To play together, Members and their avatars must either like each other or send each other an Invitation to Play.

A Like is never sent to the avatar concerned. If the Like is mutual, then a Connection is established and the two Members can play our mini-games together in their Bubble. Members with a Premium Gold subscription can find out which Members have Liked them and, if they wish, interact with them.

The invitation to play is sent to the avatar to whom it has been sent, and if it is accepted, a Connection is established and the two Members can play mini-games together in their Bubble and get to know each other.

When registering to become a Datopia member, users indicate their age and preferences, and create an avatar. To avoid false profiles, we ask our users to take a digital self-portrait, or selfie, with their smartphone. This will be their reference photo. From time to time, we'll ask them to take another digital self-portrait, which we'll compare with the reference photo. If the two photos match, the Member will be able to continue his or her activity on Datopia.

The reference photo is the profile photo attached to the Member's avatar, but if the Member does not like it, he/she can attach a photo of his/her choice. Finally, the reference photo may or may not be displayed in the Member's photo gallery.

If two Members have a connection but are not present in the application at the same time, they can start a game and wait for the other Member's answer. They will be notified by the Application when the other Member's answer arrives. They will also have access to the messaging system for asynchronous communication.

All our Members also have access to one or more single-player games.

Members can intervene on Datopia by geolocating themselves to a location other than the one they are currently in by using the Globe-Trotter mode. This feature is only available to subscribers.

Members can make themselves invisible on other Datopia Members' stations by using Incognito mode. This feature is only available to registered members. They will only be visible on the stations of members they have Liked or to whom they have sent an Invitation.

Article 1: Introduction and scope of application

The GCU define the rights and obligations of the parties in connection with the use of the Datopia Application. They form a contract between the Member and Datopia and govern access to and use of the Application's functionalities.

Datopia complies strictly with General Data Protection Regulation (GDPR)and all European and French regulations on personal data protection, confidentiality and information security.

In the event of any conflict between these TOU and other provisions, such as the General Terms and Conditions of Sale, the TOU shall prevail.
If any provision of the GCU is held to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
Datopia reserves the right to modify the GCU at any time. The Member will be informed of any updates via a notification in the Application or by e-mail. Continued use of the Application after the GTUs have been updated implies unreserved acceptance of the modifications by the Member.

Article 2: Personal data and security

2.1 Data protection

Personal data collected on the Application is processed in accordance with the law. RGPD. Datopia undertakes to protect Members' personal information and not to disclose it to third parties without their consent, with the exception of data useful for the proper operation of the application by using third-party services, themselves in compliance with the RGPD.

Datopia's personal data is stored on Google servers in the European Union.

2.2 Types of data collected

• Information provided during registration: first name, last name, age, e-mail address, profile photos, preferences, and personal characteristics.
• Location data, with the Member's explicit consent, to enable proximity-based functionalities.
• Data generated by interactions in the Application: interactions (mini-games, preferences) are collected and analyzed via AI algorithms to propose personalized recommendations and improve the quality of the services offered.

2.3 Data security

Datopia uses advanced technologies to protect Members' data against unauthorized access. However, no system is infallible, and Datopia cannot guarantee absolute data security.

2.4 Members' rights

In accordance with the RGPD, each Member has the right to access, rectify, delete, limit the processing of, and port their personal data. To exercise these rights, the Member may contact Datopia at. dpo@datopia.world.

2.5 Data retention

Personal data is kept for as long as the Member's Account is active, and for a period of 24 months after the Member's last connection. The data will then be anonymized or deleted, except where necessary for legal reasons (retention for one (1) year for legal purposes).

Article 3: Registration and use of the Application

3.1 How to download the Application

The Application is available on the Apple and Google download platforms. It can be downloaded free of charge from the Apple App Store and Google Play Store, on iPhones running IOS version 15.8 or higher or Android smartphones running version 10 or higher.

3.2 Member's rights and obligations upon registration

The Member must be at least 18 years of age and guarantees that all the information he/she provides when registering is accurate.

Datopia then assigns the Member a personal Account.

A Member may have only one Account.

Registration is carried out by the following means:

- Via e-mail address: Users must confirm their e-mail address when registering. It is the user's responsibility to provide information about him/herself, such as first name, gender, date of birth and other additional information if desired, and to provide one or more photos.

- Via Apple or Google sign in: it is up to the Member to provide information about him/herself, such as first name, last name, gender, date of birth and other additional information if he/she so wishes, and to provide one or more photos of him/herself.

Your consent to the use of your biometric data for profile certification purposes is requested when you register with Datopia. The profile certification process is compulsory in order to use Datopia's services.

By registering, the Member agrees to these Terms and Conditions as well as our General Terms and Conditions of Sale (GTCS), and undertakes to respect the obligations incumbent upon him/her, in particular those mentioned in article 6 of these Terms and Conditions.

Article 4: Services offered

Datopia is an online dating application that lets members get to know each other by playing mini-games together.

The Application offers Members profiles selected automatically on the basis of their search preferences, their activities on the Application or their characteristics.

Each Member is free to establish or not to establish relationships with other Members in compliance with these GTUs and with the law.

Under no circumstances may the Services offered by Datopia be assimilated to marriage advice or brokerage activities. Their sole purpose is to facilitate online dating via the Application, according to Members' preferences, between Members who are mutually interested in each other.

4.1 Free services
Members have access to :

• • Registration with the creation of an avatar (Doppia).
  • The possibility of virtual meetings through the application's functionalities
  • The sometimes limited use of certain functionalities or tools made available to our users
  • Access to mini-games where they can get to know each other.
  • Access to a private area (Bubble) in case of mutual interest (connection) with a number of available tools (sound, video, chat...).

4.2 Premium services
Datopia offers advanced features via subscriptions, such as :

• • The use, without limitation or with a lesser limitation than that set for free services, of certain functionalities or tools made available to its users.
  • Visibility boost to benefit from increased exposure in the Station (the home page) of other users. This feature will not be available at launch, but can be activated on demand.
  • Access to advanced customization features.
  • Globe-trotter function for relocating to another location, can be activated at will.
  • Incognito function to avoid appearing in other users' Stations (home pages), can be activated on request. You will only appear in the Stations of Members you have Liked or to whom you have sent an Invitation.
  • Possibility of replying to Members who have sent a Like, revealing their photo and avatar.

Datopia also offers non-subscription packaged purchases of some of its advanced features, such as Reveals and Boosts.

Article 5: Artificial intelligence and personalization

Datopia uses AI technologies to analyze Members' interactions, with the exception of instant messaging exchanges, and to optimize the user experience. AI personalizes profile suggestions, adjusts game recommendations, and offers experiences tailored to each Member's preferences and activities.

Members consent to the use of their behavioral data to improve recommendations via AI, in full transparency and in compliance with European laws.

Article 6: Members' obligations

6.1 Obligation of the Member at the time of Registration

To obtain Member status, the following conditions must be met:

• • Be at least 18 years old
  • Guarantee the accuracy of your information
  • Update them regularly
  • Accept our Terms of Use after having read them

Although Datopia has neither the legal obligation nor the technical means to verify the identity and age of its Members, it reserves the right to investigate in case of doubt, suspicious elements or on report, to detect any identity theft or incorrect information. During the investigation, the Account may be suspended, and Datopia may request official identification to verify a Member's suspected identity and age.

In the absence of proof or in the event of non-compliance with the GCU, Datopia may terminate the Member's Account.

Each Member undertakes to have only one Account; any additional Account may be deleted.

6.2 Member's obligations during Use
The Member must :

• • Be sincere in all the information it publishes.
  • Publish only photos without including third parties.
  • Do not divulge confidential information about others.
  • Do not publish inappropriate content
  • Keep messages exchanged with other Members confidential.
  • Respect the law: Not to condone crimes against humanity, war crimes, incitement to commit acts of terrorism and their condoning, incitement to racial hatred, hatred of persons on the grounds of their sex, sexual orientation or identity, disability, child pornography, incitement to violence, incitement to violence against women, offences against human dignity, infringement of copyright, dissemination of prejudicial statements, disturbance of the peace...
  • Do not modify, copy or access the source code of the Application, or use unauthorized tools.

Abusive behavior may result in immediate account suspension.

6.3 Personal use
The application may only be used for personal purposes. Any use for commercial, promotional, electoral or recruitment purposes is strictly forbidden. The sending of commercial or advertising messages is prohibited.

6.4 Liability
Members are solely responsible for their actions and the content they publish on the Application. In the event of non-compliance with the GCU, he/she indemnifies Datopia against any claim arising therefrom. Illegal content can be reported using the tools integrated into the Application.

6.5 Photos
Photos of a pornographic, obscene or offensive nature are strictly prohibited. Their publication constitutes a serious offence which may result in the suspension or termination of the Account.

6.6 Real encounters
For face-to-face meetings that may occur following an online meeting, Datopia recommends taking all necessary precautions. Members are responsible for verifying the identity of people they meet and for choosing public places for greater safety. Datopia cannot be held responsible for any acts or incidents caused by meetings organized via the Application.

6.7 Account management
Members must regularly check their email and notifications to stay informed of changes or updates to the Services. Members are responsible for the confidentiality of their login details and any use made of their Account.

6.8 Equipment
The equipment required to access the Services, as well as all associated costs, are the responsibility of the Member. The Member is also responsible for the equipment used in connection with the Application.

6.9 Termination by the Member
Members may deactivate or delete their Account at any time via the Application interface.

6.10 Communication with the Member

Members may receive push notifications on the Application informing them of events concerning their account and/or activity.

The Member can, from his Account, set his preferences for Push notifications.

Datopia may also communicate with its Members by e-mail. Members may at any time refuse to receive e-mails from Datopia by exercising their right to object by sending an e-mail to hello@datopia.world.

Article 7: Datopia's obligations and liability

7.1 Technical resources and safety
Datopia provides the necessary infrastructure for a quality service, compatible with iOS versions 15.8 or higher and Android versions 10 or higher. Datopia is not responsible for problems related to the Member's terminal or external failures, such as those of Internet service providers. To minimize the risk of fraudulent access to its system and data, Datopia uses firewalls and encryption and filtering devices, but unfortunately absolute security cannot be guaranteed.

7.2 Reporting and moderating illegal behavior

Datopia is not responsible for any illegal activities carried out by its Members (fraud, identity theft, invasion of privacy, prostitution, etc.). Such conduct may result in the suspension or termination of the offending Account.
Although Datopia, as a host, has no legal obligation to monitor content, it does offer a reporting system enabling members to notify us of any illegal or abusive content, and in particular of any apology for crimes against humanity, incitement to commit acts of terrorism or any apology for such acts, incitement to racial hatred, hatred of persons on the grounds of their sex, sexual orientation or identity, or disability, and in particular child pornography, incitement to violence, incitement to violence against women, and offences against human dignity. Datopia examines reported content and may remove contentious content or suspend or terminate the accounts concerned.

The Member whose content is reported will not know the identity of the Member who reported the said content.

Members can also block other users from interacting with them. This action, which is confidential, allows members to decide with whom they want no further contact.

Abusive reporting may also result in the suspension or termination of the Account that has abusively reported another Member.

7.3 Precautionary rules
The Member is solely responsible for verifying the identity of persons during virtual meetings or in real life following virtual meetings. Datopia declines all responsibility in the event of any incident whatsoever during such meetings.

7.4 Public events
It is forbidden to to use the Application to organize public or collective events. Datopia shall not be liable for any disturbance of public order resulting from such actions.

7.5 Account suspension/termination
In the event of a breach of the GCU, Datopia reserves the right to suspend or terminate an Account after due warning.

Article 8: Subscriptions and payments

8.1 Premium subscriptions
Members can take out subscriptions to access additional features. Subscriptions are renewed automatically unless cancelled via the App Store or Play Store.

8.2 Purchasing packs
Some features, such as Reveals and Boosts, can be purchased in packs of several.

8.3 Payment and security
Payments are processed and managed by the Apple and Google stores. Datopia does not store any banking data.

For this reason, Datopia has no refund facilities. These will have to be requested directly from the Apple and Google stores.

Article 9: Intellectual Property (IP)

All content, with the exception of that posted by Members, (text, graphics, trademarks) on the Application is the exclusive property of Datopia. Any unauthorized reproduction or use is prohibited.

The Member is the owner of all content provided. In this respect, the Member shall hold Datopia harmless against any legal action or judgment against Datopia arising from the Member's infringement of any third-party intellectual property rights or personality rights. The Member indemnifies Datopia against all claims or damages.

Article 10: Deactivation, deinstallation, removal, suspension and termination

10.1 Account deactivation by the Member
The Member may deactivate his Account at any time to become invisible to others. Data is retained and, if reactivated within one year, the profile and data are restored.

10.2 Uninstalling the Application
Members may uninstall the application without deleting their Account. To completely erase his data, he must first delete his Account from the application. In the event of reinstallation within one year, the data will be restored.

10.3 Definitive deletion of the Account
Members can permanently delete their Account from the application or by contacting Datopia. This action renders the Member's profile invisible and deletes all purchases made by unit or by pack, with no refund possible. Subscribing Members who decide to delete their Account must terminate their subscription to Datopia by contacting the Apple App Store or the Google Play Store.

Data is kept for one year for legal reasons before being deleted.

10.4 Suspension/termination by Datopia
In the event of a breach of the GCU, Datopia may suspend or terminate the Account following a warning. If, following notification of account suspension, the Member does not remedy the situation within 30 days, Datopia may terminate the Account, rendering the profile invisible and permanently removing the associated benefits, with no possibility of reimbursement.

The Member may not reopen an Account for one year.

10.5 Termination of inactive Accounts
Accounts that have been inactive for one year are deleted after 8 days' notice. The Member may reactivate his or her Account during this period to cancel the deletion. Once deleted, the profile becomes invisible, the data is kept for one year and then permanently deleted.

A Subscribed Member's Account is always considered active.
